This Acceptable Use Policy ("AUP") explains the rules and standards that apply when using the PocketMarket platform ("PocketMarket", "we", "our", "us", or the "Platform").
It applies to all users of PocketMarket, including buyers, sellers, businesses, service providers, visitors and other participants.
By using PocketMarket, you agree to comply with this AUP, our Terms & Conditions, Privacy Policy, Refund, Return & Dispute Policy, Marketplace Rules and any other applicable PocketMarket policies.
PocketMarket may apply additional rules to particular countries, categories, products, services or transactions where required by applicable law or operational requirements.
Nothing in this AUP is intended to restrict rights or protections that cannot legally be excluded under applicable law.
1. Prohibited Activities
Users must not use PocketMarket to engage in, facilitate, promote or attempt to facilitate unlawful, fraudulent, abusive or harmful activities.
1.1 Illegal, Prohibited or Restricted Goods and Services
Users must not use PocketMarket to list, sell, purchase, promote, distribute or facilitate transactions involving:
- Stolen goods
- Counterfeit goods
- Fraudulent goods or services
- Illegal drugs or controlled substances
- Explosives or other prohibited hazardous materials
- Illegal weapons or prohibited weapons
- Goods or services prohibited by applicable law
- Goods or services requiring licences or permits where the required licence or permit has not been obtained
- Products subject to applicable trade, import, export or sanctions restrictions
- Products or services that PocketMarket has specifically prohibited
Additional restrictions may apply depending on the country, jurisdiction, category or transaction.
PocketMarket may maintain separate prohibited and restricted-item rules for particular markets.
2. Age-Restricted Products and Services
Users must comply with all applicable age restrictions.
Users must not:
- Sell age-restricted products to persons who are not legally permitted to purchase them;
- Misrepresent a customer's age;
- Circumvent age-verification requirements;
- Use another person's account to purchase age-restricted products;
- Assist another person in bypassing applicable age restrictions.
PocketMarket may prohibit certain age-restricted categories entirely where appropriate.
3. Fraud and Misrepresentation
Users must not:
- Create fraudulent or deceptive accounts;
- Impersonate another person, business or organisation;
- Provide false or misleading identity information;
- Provide false business information;
- Misrepresent the ownership, condition, authenticity, origin or characteristics of a product;
- Use false photographs or descriptions to mislead buyers;
- Falsify delivery or tracking information;
- Submit false documents or verification information;
- Manipulate reviews, ratings or feedback;
- Conduct fraudulent transactions;
- Engage in payment fraud;
- Use stolen payment credentials;
- Conduct phishing or other fraudulent schemes;
- Attempt to obtain refunds through false claims;
- Submit fabricated evidence in a dispute;
- Operate multiple accounts for deceptive or abusive purposes.
4. Account Abuse
Users must not:
- Create accounts using another person's identity without authorisation;
- Share account credentials where prohibited by PocketMarket;
- Sell, transfer or purchase PocketMarket accounts;
- Circumvent account suspension or termination;
- Create replacement accounts to evade enforcement;
- Attempt to gain unauthorised access to another user's account;
- Attempt to access areas of the Platform that the user is not authorised to access.
Users are responsible for maintaining reasonable security over their account credentials.
5. Platform Security and Technical Abuse
Users must not:
- Introduce malware, viruses or other harmful code;
- Attempt to compromise PocketMarket's systems;
- Conduct denial-of-service attacks;
- Probe or scan systems for vulnerabilities without authorisation;
- Attempt to bypass security controls;
- Circumvent authentication or verification systems;
- Reverse engineer or exploit the Platform in a manner prohibited by applicable law or our Terms;
- Scrape or collect Platform data through unauthorised automated methods;
- Use bots or automated systems to interfere with Platform operation;
- Attempt to manipulate Platform rankings, search results or advertising systems;
- Interfere with another user's use of PocketMarket.
Security researchers who identify a potential vulnerability should report it through the appropriate PocketMarket security contact rather than exploiting it.
6. Payment and Transaction Abuse
Users must not:
- Circumvent PocketMarket's payment systems;
- Attempt to avoid applicable platform fees;
- Use fraudulent payment methods;
- Use another person's payment account without authorisation;
- Launder money through PocketMarket;
- Structure transactions for the purpose of evading applicable controls;
- Use PocketMarket to facilitate financial crime;
- Falsify transaction information;
- Attempt to manipulate refunds;
- Conduct fraudulent chargeback activity;
- Circumvent applicable payment, verification or compliance requirements.
PocketMarket may restrict, review, cancel or take other appropriate action regarding transactions where fraud, abuse, financial crime or other prohibited activity is suspected, subject to applicable law and the applicable payment arrangements.
7. Money Laundering, Terrorist Financing and Sanctions
PocketMarket must not be used to facilitate:
- Money laundering;
- Terrorist financing;
- Sanctions evasion;
- Proceeds of crime;
- Fraudulent financial activity;
- Other unlawful financial activity.
PocketMarket may apply appropriate identity verification, transaction monitoring, sanctions screening, fraud prevention and other compliance measures where applicable.
Where required or legally permitted, PocketMarket may report suspected unlawful activity to appropriate authorities or relevant service providers.
8. Harassment, Abuse and Harmful Conduct
Users must not use PocketMarket to:
- Threaten or intimidate others;
- Harass or bully other users;
- Engage in targeted abuse;
- Promote violence against individuals or groups;
- Encourage criminal activity;
- Distribute content intended to facilitate serious harm;
- Repeatedly send unwanted communications;
- Abuse reporting or dispute systems.
PocketMarket may take action against accounts involved in serious or repeated misconduct.
9. Hate and Abusive Content
Users must not use PocketMarket to publish or distribute content that unlawfully promotes hatred, violence or discrimination against protected groups.
PocketMarket may remove content that violates applicable law or Platform policies.
10. Spam and Unsolicited Commercial Activity
Users must not:
- Send bulk unsolicited messages;
- Spam listings or users;
- Repeatedly post substantially identical listings where prohibited;
- Manipulate search results through spam;
- Send deceptive promotional messages;
- Use PocketMarket messaging to distribute malware, phishing links or fraudulent offers.
11. External Links and Off-Platform Transactions
Users must not use PocketMarket to circumvent legitimate Platform controls by directing users away from PocketMarket for the purpose of:
- Avoiding applicable marketplace fees;
- Circumventing advertising systems;
- Avoiding payment controls;
- Evading transaction monitoring;
- Defeating buyer or seller protections;
- Circumventing account restrictions.
Legitimate external links may be permitted where PocketMarket expressly allows them.
12. Seller Responsibilities
Sellers are responsible for ensuring that their listings and business activities comply with applicable law and PocketMarket policies.
Sellers must:
- Provide accurate descriptions;
- Use accurate photographs where required;
- State material product characteristics accurately;
- Ensure products are genuine where authenticity is represented;
- Comply with applicable product-safety requirements;
- Comply with applicable licensing requirements;
- Comply with applicable consumer-protection requirements;
- Honour applicable warranties and guarantees;
- Fulfil accepted orders appropriately;
- Provide accurate delivery information;
- Respond honestly to customer complaints and disputes;
- Provide requested evidence when reasonably required to investigate a dispute.
13. Listing Accuracy
Users must not create listings that are materially false or misleading.
Listings should accurately communicate, where relevant:
- Product identity;
- Condition;
- Quantity;
- Price;
- Material characteristics;
- Availability;
- Location;
- Delivery information;
- Applicable restrictions;
- Warranty or guarantee information.
PocketMarket may remove or restrict listings that are materially misleading.
14. Reviews, Ratings and Feedback
Users must not:
- Purchase or sell fake reviews;
- Manipulate ratings;
- Create fake accounts to influence ratings;
- Threaten users to obtain positive reviews;
- Submit knowingly false reviews;
- Coordinate fraudulent review activity.
PocketMarket may remove fraudulent or abusive reviews and take action against accounts involved in review manipulation.
15. Advertising and Promotion
Users must not create advertisements that:
- Are materially false or misleading;
- Promote prohibited goods or services;
- Misrepresent prices;
- Misrepresent discounts;
- Use deceptive claims;
- Circumvent advertising restrictions;
- Mislead users about the identity of the advertiser.
Advertisers must comply with applicable advertising and consumer-protection laws.
PocketMarket may reject, remove or restrict advertisements that violate Platform policies.
16. Intellectual Property
Users must not use PocketMarket to upload, sell, distribute or promote content that they do not have the right to use.
Users are responsible for ensuring that their listings, photographs, videos, descriptions, trademarks and other materials do not unlawfully infringe the rights of others.
PocketMarket may remove content where it receives a valid infringement complaint or otherwise determines that removal is appropriate or required.
17. Privacy and Personal Information
Users must not use PocketMarket to unlawfully collect, disclose, sell or misuse another person's personal information.
Users must not publish sensitive personal information about another person without appropriate authorisation or legal basis.
Users must comply with applicable privacy and data-protection laws when handling information obtained through PocketMarket.
18. Circumventing Platform Enforcement
Users must not attempt to avoid PocketMarket enforcement by:
- Creating new accounts after suspension;
- Using another person's account;
- Changing identifying information to evade enforcement;
- Moving prohibited activity to another account;
- Coordinating with other users to circumvent restrictions.

Users can report suspected violations through the available PocketMarket reporting tools or by contacting:

- User or seller information;

Users should provide truthful information when submitting reports.
20. Investigation
PocketMarket may investigate suspected violations of this AUP.
Depending on the circumstances, PocketMarket may:
- Review listings;
- Review account activity;
- Review transaction information;
- Review communications where permitted;
- Request additional information;
- Request verification documents;
- Review payment or delivery information;
- Work with relevant service providers;
- Take temporary protective measures while an investigation is ongoing.
Investigations may be conducted in accordance with applicable law and PocketMarket's Privacy Policy.
21. Enforcement
Where PocketMarket determines that a user or listing violates this AUP or another applicable Platform policy, PocketMarket may take appropriate action, including:
- Warning the user;
- Removing or restricting a listing;
- Removing content;
- Restricting account functionality;
- Restricting messaging;
- Restricting selling privileges;
- Cancelling or restricting transactions where appropriate;
- Suspending an account;
- Permanently terminating an account;
- Restricting access to promotional features;
- Restricting participation in particular categories or markets;
- Taking other appropriate measures permitted by applicable law.
The severity of enforcement may depend on the nature, seriousness and frequency of the violation.
22. Payment Restrictions During Investigations
Where permitted by applicable law and the applicable payment arrangements, PocketMarket may request or support appropriate payment restrictions, transaction reversals, refunds, holds or other protective measures where necessary to address suspected fraud, disputes, prohibited activity or legal/compliance requirements.
PocketMarket will not claim or exercise rights over customer funds beyond what is legally and contractually permitted.
23. Legal and Regulatory Cooperation
PocketMarket may cooperate with courts, regulators, law-enforcement agencies, payment providers and other authorised parties where required or legally permitted.
PocketMarket may disclose information where required by applicable law, legal process or a valid governmental or regulatory request.
24. International Application
PocketMarket operates across different markets and recognises that laws and regulations differ between jurisdictions.
This AUP establishes the general global standards for use of the Platform.
Additional country-, region-, category- or product-specific restrictions may apply.
Where applicable law imposes a stricter requirement than this AUP, the applicable legal requirement will prevail.
Where a local law provides a right or protection that cannot legally be excluded, nothing in this AUP is intended to remove or restrict that right.
25. Policy Changes
PocketMarket may update this AUP from time to time to reflect:
- Changes to the Platform;
- New products or services;
- Changes in technology;
- Changes in applicable laws;
- Changes in security requirements;
- Changes in marketplace policies.

Important Legal Provision
Nothing in this AUP is intended to:
- Authorise conduct prohibited by applicable law;
- Exclude mandatory legal rights;
- Limit consumer protections that cannot legally be excluded;
- Prevent lawful reporting to regulators or authorities;
- Limit liability where such limitation is prohibited by applicable law.
Where a provision of this AUP conflicts with a mandatory requirement of applicable law, the mandatory legal requirement will prevail to the extent of the conflict.
