3. Nature of the Platform & "As-Is" Disclaimer
Disclaimer of Warranties: PocketMarket serves purely as an intermediary digital marketplace. The platform and all services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
PocketMarket does not guarantee the quality, safety, or legality of items or services advertised, the truth or accuracy of users' content or listings, the ability of sellers to sell items, or the ability of buyers to pay for items.
4. User and Seller Responsibilities
Users: Must provide accurate information during registration and transaction processes. You are solely responsible for safeguarding your account credentials.
Sellers: Are acting as independent entities and are solely responsible for the accuracy of their listings, the quality of their goods/services, tax compliance, and fulfilling orders promptly.
5. Listing Rules
All listings must accurately represent the item or service being offered. We strictly prohibit the listing of goods or services that are illegal, counterfeit, misleading, or infringe on third-party intellectual property.
6. Payments, Orders, and Refunds
- Payments: Handled securely by integrated third-party payment providers (e.g., Paystack, Stripe). PocketMarket is not a bank or payment processor and does not hold funds directly.
- Orders & Delivery: Facilitated strictly between the buyer and the seller. PocketMarket assumes no liability for delivery failures or damaged goods.
- Cancellations & Refunds: Subject to the specific terms set by the seller and the applicable dispute resolution processes on the platform.
7. Prohibited Content
Users may not post content that is harassing, abusive, fraudulent, or violates any applicable laws.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Pocket Market Ltd, its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the platform; (ii) any conduct or content of any third party on the platform; (iii) any content obtained from the platform; and (iv) unauthorized access, use, or alteration of your transmissions or content.
In no event shall Pocket Market Ltd's aggregate liability for all claims relating to the platform exceed the greater of one hundred US Dollars ($100) or the amount you paid us, if any, in the last 12 months.
9. Indemnification
You agree to defend, indemnify, and hold harmless Pocket Market Ltd and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of and access to the platform, or your violation of any term of these Terms.
10. Account Suspension and Termination
We reserve the right, at our sole discretion, to suspend or terminate your account and access to the platform without prior notice or liability, for any reason, including without limitation, a breach of these Terms.
